Who's Responsible for Cannabis Safety in Germany?

Germany made headlines in 2024 as the largest European country to legalize cannabis for adults. But the reality is more nuanced than "legal weed." You can possess it, grow a few plants, and join a non-profit club to get it, yet there is still no recreational shop to walk into. The place where cannabis is most tightly controlled for safety is, of all things, the pharmacy.

Here is how each of Germany's cannabis channels keeps its product safe.

The short version: Germany's medical cannabis is a pharmacy product tested batch by batch to a pharmacopoeia standard. Its adult-use supply comes from home growing or non-profit clubs, which have their own lab-testing and labelling rules. Commercial recreational sale does not exist yet.

What you can actually get

Since April 2024, adults can possess cannabis and grow up to three plants at home. Since July 2024, non-profit "cultivation associations," often called cannabis clubs, can grow and hand out cannabis to their members, capped at 500 members each, with no advertising and no sale to the public. What Germany does not have, as of now, is a licensed recreational store. Those commercial pilots have not launched.

Alongside all of that runs a medical cannabis program that has existed since 2017, where doctors prescribe cannabis dispensed by pharmacies.

Who checks that it is safe: the pharmacy channel

The medical route is where Germany's safety machinery is strongest, because cannabis there is treated as a pharmaceutical:

The grower works to Good Agricultural and Collection Practices, then the product moves into a pharmaceutical-grade (EU-GMP) facility.

A qualified person at that facility releases each batch only after it passes quality control, the same gate any medicine goes through.

The pharmacy runs its own identity check on the incoming batch before handing it to the patient, and dispenses on a prescription.

The federal drugs regulator (BfArM) licenses the importers and oversees the system.

What "tested" actually means

German medical cannabis is tested against a published pharmacopoeia standard, the German and European Pharmacopoeia monographs for cannabis flower. Every batch is checked for:

Potency: the THC and CBD content, which must match the label within about 10%.

Pesticides and heavy metals.

Microbial contamination, and aflatoxins (a mold toxin) held to a strict limit.

Identity, confirming the material is really what it claims to be.

Cannabis clubs sit under a lighter but real regime: their harvest must be lab-tested for THC and CBD plus pesticides, mold toxins, heavy metals and microbes; it comes in plain, child-resistant packaging with a leaflet listing the variety, harvest date, and average potency; and for members aged 18 to 21 the THC is capped at 10%. State authorities license and inspect the clubs.

The twist: legal to hold, hard to buy

Germany is the mirror image of a US recreational state. In Colorado you buy tested cannabis from a shop, but the state runs the testing regime; in Germany there is no shop at all for recreational users, so the strongest safety controls live in the medical pharmacy channel, with clubs and home growers filling the adult-use gap under their own rules.

What it means for you

In Germany, "where did this come from" tells you how safe it is. Pharmacy cannabis carries the full weight of pharmaceutical batch testing. Club cannabis is lab-tested and labelled under association rules. Anything bought from a dealer or an unlicensed shop is outside both systems, and outside the testing that makes them trustworthy.
